General Terms of Use

These General Terms of Use (the "Terms") constitute a legally binding agreement between Covenant AI SAS, a French company ("Pegasia.ai", "We", "Our" or "Service Provider") and you, or the entity you represent ("You", "Your" or "Client"), governing your use of the website Pegasia.ai and all associated services provided by Pegasia.ai (collectively, the "Services").

PLEASE READ THESE CONDITIONS CAREFULLY. By accessing our website, registering, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Services.

Article 1. Definitions

In these Terms, the following terms have the following meanings:

  • "Services": The outsourced application solutions of Pegasia.ai, including, but not limited to, image generation, transcription and summary of meetings, blog writing, SEO audit, communication with specialized AI agents, and the creation of discussion groups with an AI agent. The Services evolve over time and may include additional or modified functionalities.
  • "Data": The Client's electronic data, whether personal or not, which is collected, processed, and shared via the Services. This includes information provided by users, data generated by the use of the Services, and associated metadata.
  • "Content": Any data, information, or content generated, processed, or shared by the Services, including images, texts, audios, videos, and other media. The Content may be created by users or generated automatically by the Services.
  • "Use Policy": The rules and guidelines governing the use of the Services, including privacy policies, financial conditions, and user responsibilities.

Article 2. Acceptance of the Terms

By registering or using the Services, you agree to be bound by these Terms. Pegasia.ai reserves the right to modify these Terms at any time. The modifications will be published on our website and will take effect immediately. Your continued use of the Services after the publication of the modifications constitutes your acceptance of the modified Terms.

It is your responsibility to regularly consult the Terms to be aware of any possible modifications. In the event of a major modification, we will endeavor to inform you by email or by notification on our website.

Article 3. Description of the Services

Pegasia.ai offers a range of services boosted by AI, including but not limited to:

  • Image generation: Creation of personalized images from textual descriptions, allowing users to generate unique visuals adapted to their needs. Users can specify styles, colors, and specific elements to personalize the generated images.
  • Transcription and summary of meetings: Conversion of audio meetings into text and generation of concise summaries, facilitating note-taking and the tracking of discussions. Users can upload audio or video files, and the Services will provide a textual transcription as well as a summary of the key points.
  • Blog writing: Assistance with the creation of content for blogs, including the generation of ideas, the writing of drafts, and SEO optimization. Users can specify subjects, keywords, and writing styles to generate personalized content.
  • SEO Audit: Analysis and recommendations to optimize the search engine ranking of your content, thus improving visibility and ranking on search engines. Users will receive detailed reports on the SEO performance of their content and suggestions for improving it.
  • Specialized AI agents: Interaction with AI agents for advice and specialized discussions in various fields, offering expert and personalized assistance. Users can ask questions and receive detailed and relevant answers in specific domains.
  • Discussion groups with AI agents: Creation of discussion groups including AI agents for thematic exchanges, fostering collaboration and the exchange of ideas. Users can create discussion groups on specific subjects and invite AI agents to participate.

The Services offered by Pegasia.ai are designed to evolve over time. We reserve the right to add, modify, or remove functionalities or services at our discretion, in order to continually improve the user experience and to meet the changing needs of our clients. Users will be informed of significant modifications made to the Services via our website or by email.

Article 4. Privacy Policy

The confidentiality of your information is of paramount importance to Pegasia.ai. We are committed to protecting your personal data and to respecting your privacy in accordance with our Privacy Policy.

The information and documents exchanged between you and Pegasia.ai within the framework of the Services will be treated as confidential and will not be disclosed to third parties, unless it is necessary for the execution of the Contract or required by law. You also commit to preserving the confidentiality of the information and not to disclose it to unauthorized third parties.

We implement appropriate security measures to protect your data against unauthorized access, disclosure, alteration, or destruction. These measures include data encryption, the use of firewalls, and strict security protocols.

Article 5. Financial Conditions

Pegasia.ai offers different subscription plans to access its Services. The Services are available via monthly, quarterly, or annual subscriptions. The details of the subscription plans and their costs are available on our website. The rates can be modified at any time, and clients will be informed of these changes either by manually consulting the pricing page, or by email.

Subscriptions:

  • The monthly subscription is billed on a monthly basis, without a minimum duration commitment.
  • The quarterly subscription is billed on a quarterly basis, with a commitment for the duration of the quarter.
  • The annual subscription is billed on an annual basis, with a commitment for the duration of the year.

Subscriptions can be modified or terminated at any time, subject to the termination conditions described in these Terms.

  • Payments: Payments are made by bank card or direct debit. You agree to provide valid payment information and to keep this information up to date. Payments are processed securely via authorized payment providers.
  • Trial period: Pegasia.ai offers a free trial period of 7 days. No commitment is required during this period, and you can cancel at any time without charge. At the end of the trial period, your subscription will be automatically converted to a paid subscription, unless you cancel it before the end of the trial period.

Article 6. Refund Policy and Termination Conditions

You may cancel your subscription at any time by following the instructions on our website or by contacting us by email at: support@pegasia.ai. We will send you a confirmation email, and your subscription will end at the end of the current billing period.

In accordance with applicable law, you have a period of 14 days from the date of your subscription to exercise your right of withdrawal. If you are not satisfied, simply contact our support at support@pegasia.ai at least 2 days before the end of this period to obtain a full refund.

After this 14-day period, no refunds will be issued for any subscription periods already paid. The Services will remain accessible until the end of the current subscription period.

Pegasia.ai reserves the right to suspend or terminate your account in the event of a violation of these Terms or any applicable law. In case of suspension or termination due to a violation, no refund will be issued.

Article 7. Customer Support

Technical support is available from 9am to 6pm (French time), from Monday to Friday, via livechat or email at the following address: support@pegasia.ai. The average response time is one hour. Our support team is dedicated to helping you with all your questions and concerns regarding the use of the Services.

We are committed to providing high-quality technical support and to answering all your questions in the best possible time. In case of a technical problem, our team will do everything possible to resolve it quickly and efficiently.

Article 8. Responsibilities and Limitations

You are responsible for the use of the Services in accordance with all applicable laws and regulations. Any illegal use of the Services, including the violation of intellectual property rights, the creation of illegal content, or any other activity prohibited by these Terms, may result in a warning or an immediate ban from the platform without a refund.

Pegasia.ai reserves the right to monitor the use of the Services to ensure compliance with these Terms and to take all necessary measures to prevent or remedy any abusive or illegal use. This includes the right to suspend or terminate your account, to delete content, and to take legal action against users who violate these Terms.

You are also responsible for the security of your account and your identification information. You must take all necessary measures to protect your account against unauthorized access and inform Pegasia.ai immediately in case of compromise of your account.

Article 9. Intellectual Property

You retain all intellectual property rights to the content generated via the Services. Pegasia.ai does not claim any rights to the content you create.

By using the Services, you grant Pegasia.ai a non-exclusive, worldwide, and royalty-free license to use, reproduce, modify, and display the content generated via the Services, solely for the purpose of providing you with the Services.

We do not use the generated content to improve our algorithms or perform analyses to improve the quality of our Services. You remain the sole intellectual owner of the generated content, and we are committed to respecting your intellectual property rights and not using your content for commercial or other purposes without your explicit consent.

Article 10. Legal Compliance

These Terms are subject to French law. Any dispute arising from or related to the use of the Services will be subject to the exclusive jurisdiction of the courts of Paris. You agree to submit to the exclusive jurisdiction of these courts and waive any objection concerning the incompetence or inconvenience of the forum.

By using the Services, you agree to comply with all applicable laws and regulations, including laws on data protection, intellectual property, and consumer protection. You also agree to respect the rights of other users and not to use the Services for illegal or unethical purposes.

Article 11. Miscellaneous

Any communication relating to your account or the use of the Services will be by email or via a manual verification on the site. Pegasia.ai reserves the right to modify or suspend the Services at any time, with or without notice, for reasons of maintenance, updating, or improvement of the Services.
